Terms and Conditions
- Article 1
Rip Curl Europe, a simplified joint stock company with a capital of 1.000.000 €, registered with the Dax Trade Register (RCS) under number 332.899.731, and with its head office at 407 Avenue de la Tuilerie 40150 Soorts-Hossegor, France (the “Organising Company”) is holding a contest game on the website www.ripcurl.eu (hereinafter referred to as “the Website”) from 2 to 24 January 2019 included until midnight.
- Article 2
This contest is open to any individual aged 18 years old and over, residing and having a valid address in one of the countries of delivery of the Website, except employees (and their family members) of RIP CURL, its subsidiaries, Rip Curl Stores and any company or person that has been involved closely or by far in the concept of this contest. A valid Email address along with a valid identity document (as required by the airline company) are also compulsory to access this contest game.
- Article 3
To enter the contest game, the candidate must simply go to the address www.ripcurl.eu, fill out the forms with the required information at each step before 24 January 2019 11:59pm (French time). Only one contest entry is permitted per contestant in case a same contestant plays several times, his/her first participation shall only be taken into account. Any inscription received after the closing day or incomplete/indecipherable will be deemed invalid.
- Article 4
Major and runner up prizes will be drawn by The Organizing Company on 25th January 2019 at 407 Avenue de la Tuilerie, 40150 Soorts-Hossegor, France and the winners will be contacted in writing via email. The winners must claim their prize 4th of February 2019 midnight (10 days from the day the winner was chosen) by contacting Rip Curl. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize (or an element of the prize) by that time, then the prize will be forfeited. The winner’s names may be published on the Website (providing the winner claims his/her prize within the time required). The winner gives his/her express consent for this publication of his/her name. A redraw of any Prize Pack not claimed will take place if the winner does not claim their prize, at 5:00pm GMT on 5th of February 2019 (10 working days from the day the winner was chosen). The redraw Prize must be claimed by 5:00 pm 15th of February 2019. If not the Prize is forfeited and Rip Curl has no obligation to make further draws or provide the prize to any persons, including the previously selected winners. If any prize (or part of any prize) is unavailable, the Organizer, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. The winner authorizes any verification on their identity, age and place of residence. It is expressly agreed that the date contained in the information systems in the possession of the Organizer or its technical suppliers have probative value as to the connection elements and the determination of the winner.
- Article 5
The draw by lot shall determine the winner of the following prize: - The total prize pool for the promotion period is 3000 €, one ski week for the period from 9 to 30 March (Saturday to Saturday) in Saint Gervais Mont Blanc including: o $2000 flight voucher (prize does not include domestic transfers or transport). o 1 x Pack of Rip Curl product (to be determined at time of prize draw) o 6 nights’ accommodation at for up to two people (no meals included) o 2 skiing pass for Evasion Mt Blanc o 2 entries at the “Thermes de Saint Gervais” • Product is non-exchangeable or refundable. • No more than two people may utilize the accommodation provided Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
- Article 6
The Organizer accepts no responsibility for any disputes relating to the terms of awarding prices. The prizes are accepted as they are announced on site of the game. They may not be exchanged or returned or be the subject of a financial equivalent. No change (size, color, style, thickness…) can be allowed by the Organizer. In any event, the terms and conditions of delivery of the prize, the possession and use of the prize will be as defined by or provided by the Organizer and the winner agrees to accept, failing which the Organizer shall reserve the option of appointing an alternative winner. Any complaints regarding the provision of the prize cannot consist of a financial equivalent. The Organizer reserves the right to substitute the prize with prize of equivalent value, with no claim being made in this regard. In no event shall the Organizer be held responsible for the timely provision of the prize, or if it is impossible for the winner to receive the prize for circumstances beyond the control of the Organizer. The Organizer shall not be held responsible for any incidents or damages of any kind that may occur because of the enjoyment of the prize, and/or its use.
- Article 7
Entering the contest and the vote implies the contestant’s knowledge and acceptance of the Internet's characteristics and limitations, particularly with regard to technical performance, response times when checking, querying or transferring data, the risks of interruption, connection-related risks, the lack of protection against possible diversion of certain data and risks of contamination by any viruses in circulation on the Internet. The Organising Company may not be held liable, in particular, for malfunctions that may affect the Internet or for any problem with the configuration or relating to a specific browser. The Organising Company does not guarantee that the Internet site and/or Contest shall operate without any interruption, that they do not contain any computing errors, or that any detected errors will be corrected. The Organising Company may not be held liable in the event of a technical malfunction in the Contest, if contestants or voters are not able to log on to the Contest website or to enter the Contest, if it does not receive the data relating to a contestant’s entry form for any reason for which it may not be held liable (for example, an Internet connection problem due to any reason at the user’s premises), or if an entry form is illegible or impossible to process (for example, if the contestant or voter has hardware or a software environment that does not comply with his/her subscription) or in the event of email routing problems. Contestants and voters will not be entitled to any compensation in this regard. Moreover, the Organising Company may not be held liable for any damage, material or immaterial, caused to contestants, their computer equipment and the data stored therein, or for any direct or indirect consequences that may ensue, particularly consequences on their personal, professional or commercial activity.
- Article 8
Entering this contest implies full and unreserved acceptance of the terms set out in these rules. Any breach of any of the provisions in these terms and conditions will result in disqualification of the person having committed such breach. Any dispute as to the interpretation thereof will be decided by the organizers. Any complaint must be sent before 31st January 2018 by registered letter with acknowledgment of receipt addressed to RIP CURL EUROPE 407 Avenue de la Tuilerie 40150 SOORTS HOSSEGOR, France. These complaints may only concern material conditions of the Contest’s implementation.
- Article 9
The Organising Company reserves the right to revise these rules at any time and to take any decisions it deems useful for the application and interpretation of the rules. The Organising Company may inform contestants of a revision by any means of its choosing. The Organising Company also reserves the right to modify, extend, cut short, suspend or cancel the Contest, without warning, due to an event beyond its control, and in particular in the event of force majeure or an act of God. The Organising Company reserves the right, in particular, if there is due cause, to declare invalid and/or cancel all or part of the Contest if it appears that fraud or malfunctions have occurred in any form whatsoever, particularly in computing aspects within the framework of entry to the Contest or determination of the winner(s). In this case, it reserves the right not to award the prize(s) to the fraudulent contestants and/or to commence legal proceedings against the persons having committed the fraud. An act of fraud immediately disqualifies the person having committed it. The Organising Company will not be liable in regard to the forgoing, and therefore the contestants will not be entitled to any indemnity or compensation of any nature.
- Article 10
It is reminded that to enter the Contest and to vote, the contestants and the voters must necessarily provide certain personal information relating to them (name, country, Email address, DOB and gender). This information is recorded and saved in an electronic file and is essential to the eligibility of their entry, the determination of the winner and the attribution and routing of the prizes. This information is provided to the Organising Company and may be submitted to its technical service providers and any service provider handling the organization of the prize (e.g. airline company, hotel, surf school….etc). These third-parties shall use and disclose the information only for the purpose for which it was originally collected and when sufficient technical and organizational security measures exist. In entering the Contest, the contestant may also register to receive an email newsletter from the Organising Company's partners and/or from the Organizing Company itself. The data thus collected may be used within the legal framework and an unsubscribe link shall be available anytime. Entrants consent to the Organizer using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Organizer. In accordance with applicable French law and European Union’s General Data Protection Regulation, contestants have the right to opt out, access, update or correct the data relating to them. - Article 12
Enforcement of these terms and conditions is subject to French law alone.
